In the state of Georgia you are innocent until proven guilty as it should be not only in the courtroom but in the public eye. Statistics show it is many has 15% of the Georgia prison population are innocent of the crimes that they were incarcerated for. I know Jessica personally and I believe it any shadow of a doubt she is not guilty of murder it was a very tragic accident. However this blog was started before she was arrested. Her guilt or innocent in her existing case does not take away from the fact so she does bad things . She enjoys causing pain to other human beings this brings her a sense of empowerment. She acts all sweet and innocent and blames everyone else for all of her problems but she's actually a wolf in sheep's clothing. That is what I have thought of her for the last few years. She's at two men go to prison for her drug charges she has had for drug charges of her own not including this latest and she's never done more than 6 months in prison she has six children with for man and custody of none of them she's an addict a thief a liar a cheater an adulteress and she has been a prostitute since she was eighteen so her guilt or innocence can this case will not matter because she's going to do three years no matter what for violation of probation.

ReplyDeleteExplain please how you believe that lethal levels of an opioid chemical "accidentally" ended up in Amy's blood? I'm genuinely interested in how you think that could happen on accident.
ReplyDeleteI didn't ask about the ways that chemicals act on the human body. I'm asking about the sequence of events that you imagine could've led to Amy accidentally ingesting a lethal dose of heroine. You used the word "accident." What does an "accident" look like in this context?
DeleteAnd you think a heroine addict would be so careless with the only thing that mattered to them in the whole world? The thing they pine for day and night? The thing they sacrifice everything else in their life to get? But it's just out on the counter in plain view for Amy to see and take for some reason. Come on now.

DeleteGet truth: In Georgia, Felony Murder can be prosecuted for a death that occurs UNINTENTIONALLY while another felony is in progress. For example, if two people rob a liquor store together at gunpoint and Person A's gun accidentally goes off and kills someone, Person B will still be charged with Felony Murder because the death arose as a consequence of another felony.
DeleteThat's what's happened with Jessica Eubanks. Amy died (possibly accidentally, but probably not accidentally) while Jessica was committing another Felony (possession of a schedule 1 or 2 drug with intent to distribute). The state doesn't have to prove that Jessica intended to kill Amy or that it wasn't an accident because it doesn't matter, it's still murder under the law. So fundamentally in this case you're wrong, there IS NOT "a big difference in murder and a tragic accident." This really isn't an issue of judging her prematurely because there isn't much room for doubt that 1) Amy died of a drug overdose, and 2) Jessica was committing Felony possession at the time which somehow led to Amy's death. So unless the Judge believes that Amy obtained her own drugs independently of Jessica, the Felony Murder charge is going to stick.
There are numerous cases like this that you can read about where two people are using schedule 1 drugs together, one overdoses and the other is charged with felony murder for the simple fact that the death arose as a result of felony crime that they were party to. Most of those are cases where the person who died is taking the drugs willingly because they're already addicted themselves, but their dealer and accomplices are being charged with murder. So just think of how much harder the law will come down on someone who's drug use led to the death of a non-addict who's mentally still a child.
Short version: Jessica Eubanks is probably going away for a very long time.

DeleteKharma Hunter, Felony Murder is First Degree Murder in Georgia. The sentencing for that varies widely from just a few years, up to the death penalty, and everything in between.
DeleteIf Methamphetamine was involved, the possession with intent to distribute charge alone carries a minimum five year sentence with a 40 year maximum due to a federal mandate passed in 2005 called the "combat methamphetamine epidemic act" or CMEA. That's if she had five grams or more of methamphetamine. Under the same federal requirement, if she had 50 grams or more it's a 10 year minimum sentence with a maximum of life in prison. The federally required minimums for heroin possession are not nearly as severe unless there was a significant quantity. And of course there are huge fines associated with all of the above that are likely to be garnished from any future earnings.
There are many factors that are likely to influence the ultimate sentencing for Jessica such as her criminal history, the protective order violation occurring at the same time, the fact that Amy wasn't an addict herself and likely wasn't aware of the danger that taking Jessica's drugs posed to her life or even what narcotics are, and the amount of Schedule 1 drugs that Jessica had in her possession at the time. It's very difficult to estimate how the judge in the case and the prosecution team will view this particular combination of circumstances; but many states including Georgia have taken a severe view of drug-related felonies that result in fatalities. There are many recent cases like this that you can read about online which might provide some insight.
Consider the 2018 case of Brandon Anthony Schneider who was at fault in a fatal car accident in Forsyth County while under the influence of GHB. He had a prior drug conviction, and he pleaded guilty to homicide by vehicle and other lesser charges. He was given a 25 year sentence with 10 to be served in prison and 15 on probation.
Or consider the 2015 Fulton County case of Graham Williams who allegedly injected another man with that man's own heroin which resulted in his death. Williams did not buy the drugs, or sell them, or use them himself, he merely assisted the other man in administering them upon his request. Williams did not have any prior drug convictions and he even claimed to have performed CPR on the other man until medical first responders arrived. But because Williams participated in a drug felony that resulted in death, he was charged with Felony Murder. Initially the murder charge was dismissed by the Judge but just this year it was reinstated by the State of Georgia, overruling the prior dismissal. The case is still tied up in court, but even for a role in the crime as minor and seemingly pardonable as this, the charge was not permitted to be pleaded down to something other than Felony Murder. The law does not usually see deaths resulting from felonies as being involuntary, because they're not involuntary. Serious drug crimes are classified as felonies because they pose significant danger to human life, and engaging in them is a willful act of disregard for that danger regardless of how the danger manifests itself or what the intent of the perpetrator was or wasn't.

ReplyDeletelease stop referencing the children she didn't have custody of. You do not know all the facts regarding any of them. They are innocents and minors. They should be left out of everyone's thoughts, comments (written/verbal) and is no one's business. You want to go at Jessica? That's your prerogative but leave innocent lives out of this blog. It is wrong and disgusting. One day they may read this blog and possibly others they interact with in school, clubs, church, etc. I would hate for this blog to be cause for any harm to befall them or be responsible fordamage to their person- mentally, physically or emotionally. So stop it now and I BEG AND PLEA to the blog keeper to delete any comments referencing children.
ReplyDeleteAshley I do have all the facts I know exactly how she lost all of her children the last two we're product of adultery the one before that she abandoned in a hotel room the one before that she wouldn't even show up to court to try to get her back I'm sure she has an excuse and an answer for all of those fact is she's a horrible person and her kids are much better off without her in their life if the great Creator is a merciful god. he will keep her locked away until the kids are adults

DeleteUnfortunately the title of the blog is "evil monster" and abandoning all 6 of her children is s big part of what makes her such a piece of shit. Truth hurts sometimes. Would you rather they grew up under the misconception that she loved them? They will be adults one day and it would be a sadder situation for them to think everyone else knew but didn't care. That's right, just stick it in the closet .
